Texas Packaging Systems, Inc. will be re-starting our business in March 2010.  For those clients that have been waiting for us to reopen we want to thank you for your patience and understanding.   Over the past few months we have received numersous phone calls and emails asking TPS when the opening date will be and if we would be interested in representing their lines of machinery and supplies.  And of course why did we close our doors after only 9 months of startup.

Well, we will be opening March 2010 and Yes we are still looking for new manufacturers to represent in the states of Texas, Arkansas, Louisiana, New Mexico and Oklahoma.  As before we are interested in becoming our manufacturers best performing representative group for the territory and not interested in becoming a distributor at this time.  Possibly in the near future we will stock supplies and packaging materials. 

The reason that we closed after only 9 months to put it briefly, we simply jumped the gun.  The long version is we had an old client that wanted to purchase exclusivly from us and also to receive the benefit of TPS providing service after the sale.  And they wanted service Now!  They also wanted to begin purchasing supplies through TPS as exclusive representatives for manufacturer of RPET Products. We sold our client several machines and supplies but we were setting up the business in order to provide the client with RPET products at a substancial discounted rate per thousand than they were paying.  And we were to provide them with an updated version of their product and maintain its quality throughout production. 

The current supplier had failed to provide a perfected product after one year of production and we were chosen to begin replacing all the clients RPET once prototypes were completed and accepted.  We had just begun testing the prototypes and the clients current supplier decides to sue our client for their attempts to change vendors claiming the designs being used to improve were the exclusive property of the vendor.  However, we were told that the client had paid for all R&D and proto types of these products and all the tooling.  Therefore the designs belonged to our client and they could use them as they saw fit.  Once the suit was filed that was the end of the continuing product sales to our client and we had to let an old valued client seek support from another company not wanting to be drawn into the law suit ourselves after just starting business.  Yes, we consider what took place to be unfair since we trust our client paid for all of the work to produce these products.  Including all the R&D costs. 

Where we had not performed in bad faith and had not taken designs from their current vendor but had been given each base design from our client to work from.  So we were not liable for any damages and had acted with proper business ethics.  We have not heard if that suit has settled or what became of it but we hope both parties can reach a mutual agreeable conclusion. 

So, I hope that clears up the questions concerning our closing after 9 months.  We simply did not have enough business waiting in the future in order to keep our doors open.  For the last few months we have been in contact with old clients as well as potentially new clients and we have received several requests to provide product, service and supplies for their current and future projects.  Therefore we have business waiting for us to begin again.  Which is a great way to start a new business.
